Terms and Conditions for FuturePivots

Introduction & Acceptance

These Terms and Conditions govern the purchase of any products (physical or digital) or services (coaching, online courses) from FuturePivots (ABN 36891390698) via futurepivots.com.au (the "Site").

By accessing our Site, purchasing our products, or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Eligibility (18+)

This Site is intended for people who are 18 years of age or older. By using this Site, you confirm that you are at least 18 and have the legal capacity to enter into a binding agreement.

Other policies (Privacy + Disclaimer)

Your use of this Site is also subject to our Privacy Policy and Website Disclaimed (each incorporated into these Terms by reference). If you do not agree to those policies, you must not use this Site.

License to use our Digital Products & Memberships (courses, templates, downloads)

When you purchase (or access) any course, coaching program, template, toolkit, download, or other digital product (collectively, “Digital Products”), we grant you a limited, personal, non-exclusive, non-transferable licence to use the materials for your own personal use or internal business use.

  • Access: Upon purchase of a digital course (such as PivotPlans like "The Boss of Your Future”) or joining The Pivot Collective, you are granted a non-exclusive, non-transferable license to use the materials for personal or internal business use only.
  • Restrictions: You must not
    • share your login or materials with anyone else;
    • redistribute, re-sell, or "white-label" our strategic frameworks, templates, or course content without express written soul permission;
    • copy of reproduce the materials for anyone else
    • create competing products or services based on the materials; or
    • claim the materials as your own.
  • If we believe materials are being shared or misused, we may suspend or terminate access without notice.
  • The Pivot Collective: Membership is billed on a [Monthly or Annual] basis. You may cancel at any time, but refunds are not provided for partial billing cycles unless required by Australian Consumer Law.

Free resources

  • If we provide free resources (for example, via an email opt-in), those resources are for your personal use or internal business use only and must not be sold, shared, or redistributed.

Accounts

When you create an account on our Site, you agree that:

  • you are solely responsible for your account, including keeping your password secure; and
  • the information you provide is accurate and up to date.

We reserve the right to suspend or terminate your account if you use the Site illegally or breach these Terms.

Sales or Goods and Services (including Orders and Pricing)

These Terms govern the sale of goods and services available on our Site, including:

  • Online courses; and
  •  Coaching

These Terms apply to all products displayed on our Site at the time you access it. We do our best to ensure descriptions and images are accurate, but you agree that you purchase at your own risk.

We reserve the right to modify, reject, or cancel your order if necessary. If we cancel an order and payment has already been processed, we will provide a refund equal to the amount you paid.

  • Order Acceptance: An order is an offer to purchase; a contract is only formed when we send an order confirmation.
  • Pricing: All prices are in Australian Dollars (AUD) and GST with be indicated as included or additional in the checkout cart. We reserve the right to change prices without notice before an order is accepted.

Payment

Payments are processed through secure third-party gateways (e.g., Stripe, PayPal). We do not store your full credit card details. Access to digital products is only granted once payment is confirmed.

We accept the following payment methods:

  • Credit Card
  • PayPal
  • Debit
  • Direct Debit

By providing payment information, you authorise us to charge the payment method you have selected.

If we believe a payment violates any law or these Terms, we reserve the right to cancel or reverse the transaction.

Subscriptions

Your subscription does not automatically renew. You will be notified before your next payment is due and must authorise that payment for your subscription to continue.

Payment Plans

From time to time, we may offer payment plans for our courses, programs, and coaching services.

By choosing a payment plan, you agree that:

  • Payment plans are not subscriptionsand represent a commitment to pay the full purchase price, split into instalments.
  • You are responsible for ensuring sufficient funds are available for each scheduled payment.
  • All payment plan instalments must be completed in full, regardless of whether you continue to access or engage with the program.

If a payment fails, we may attempt to reprocess the payment automatically.

If five (5) payments fail, we reserve the right to:

  • Suspend or withdraw access to course content, coaching, or program materials until payments are brought up to date; and
  • Continue to pursue the outstanding balance owed under the payment plan.

Access will be reinstated once overdue payments are successfully processed.

Payment plans do not change our no-refund policy for digital products, except where required by Australian Consumer Law.

Delivery & Shipping

  • Digital Goods: Digital products are delivered via the email address provided at checkout. Please ensure your digital security settings allow for external attachments or links.
  • Physical Goods: We ship within Australia using Australia Post or other couriers. Estimated delivery times are 3–7 business days, though international or regional delays may occur.
  • Risk: Risk of loss or damage passes to you upon delivery.

Provision of Services (Consultancy)

  • Standard: Services will be provided with professional care and skill, drawing on established strategic foresight and risk management methodologies.
  • Cancellations: For consultancy sessions or workshops, 48 hours' notice is required to reschedule. Cancellations made with less than 48 hours' notice may incur a [Insert %] fee.

Refunds & Returns (Australian Consumer Law)

Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).

  • Digital Products: Due to the nature of digital content and immediate access, all sales of digital products are final and non-refundable, including online courses, downloadable resources, templates, toolkits and trainings.
  • This does not exclude your rights under Australian Consumer Law.
  • Major Failures: If you experience technical issues accessing your purchase, please contact us and we will assist. You are entitled to a replacement or refund for a major failure (e.g., a technical defect that prevents the course from being viewed) and compensation for any other reasonably foreseeable loss.

Intellectual Property

All content published and made available on this Site, including the FuturePivots logo, the PivotPlans curriculum, videos, audio, images and all downloadable files,  templates, guides, checklists and anything that contributes to the composition of our Site or products is the property of FuturePivots and protected by Australian and international copyright laws.

You may not copy, reproduce, republish, upload, post, transmit, sell, sublicense, or distribute any material from this Site without prior written permission.

Educational purposes only

All content on this Site and in our Digital Products including all templates, cheat sheets, guides, calculators, and strategic recommendations, is for educational and informational purposes only. Nothing we provide is legal, financial, accounting, medical, or other professional advice.

It is designed to help participants develop their own personalised preparedness strategies. You are responsible for your own decisions, actions, and results.

The Author (FuturePivots) is not a certified first responder, medical professional, structural engineer, or licensed financial advisor. This guide does not replace professional advice from local authorities, emergency services, or qualified experts. You should consult with relevant professionals before making significant changes to your home infrastructure (such as solar/electrical installations) or medical protocols.

Limitation of Liability

To the maximum extent permitted by law, FuturePivots and its representatives shall not be liable for any direct, indirect, incidental, or consequential damages (including, but not limited to, physical injury, property damage, or financial loss) resulting from the implementation of the strategies outlined in the products or services accessed through this Site. By proceeding, you agree to indemnify and hold harmless FuturePivots from any claims, losses, or expenses arising from your preparedness actions or decisions. Liability is limited to the resupply of the services or a refund of the purchase price.

FuturePivots provides strategic advice and resilience frameworks. While we aim to increase preparedness, we do not guarantee specific business outcomes or immunity from external market/geopolitical risks.

Assumption of Risk

Emergency preparedness and household preparedness involves inherent risks. By using this training, you acknowledge that you are responsible for your own safety and the safety of your household. Future Pivots assumes no responsibility for the accuracy, completeness, or practical application of the information provided, nor for any consequences arising from the use or misuse of these materials.

Indemnity

Except where prohibited by law, you agree to indemnify and hold harmless FuturePivots from any claims, losses, damages or expenses arising from use of the Site or breach of these Terms and your preparedness actions or decisions.

Local Compliance

Emergency regulations and safety standards vary by region and country. It is your responsibility to ensure that your preparedness and planning complies with local/state/federal laws, building codes, and emergency management directives.

Applicable Law

These terms are governed by the laws of the New South Wales (NSW). Any disputes shall be handled within the courts of the NSW.

Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

Changes to these Terms

We may update these Terms from time to time. The current version will always be available on this page, and continued use of the Site means you accept the updated Terms.
